Freedom of Information & Protection of Privacy

The Freedom of Information and Protection of Privacy Act is a law that came into effect in British Columbia in 1993. The Act provides individuals with specific information and privacy rights with regards to information that is collected and controlled by the Village of Nakusp.

Most of the Village’s information is available to you upon verbal request. Please ask the Village staff and they will be pleased to assist you wherever possible.

Formal Freedom of Information (FOI) Requests

The Freedom of Information and Protection of Privacy Act applies to all records that are under the custody or control of a public body. If the information you are seeking is not available through routine channels, you may make an Freedom of Information request for records.

Unlike routine requests, the Act requires that requests for access to records not regularly available be made in writing. Your written request must provide sufficient detail to assist staff in locating and retrieving the records you are looking for.

We will process your request as quickly as possible and within the 30 business day time frame specified in the Act. If your request is broad in scope, or if a large volume of records relate to your request, we may extend the time limit for responding under the Act for an additional 30 business days.

Making a Request for Access to Records

You may make a request for access to records by using a Request for Access to Records form, or by writing to the Village of Nakusp. All requests must be made in writing and signed by the applicant. If you have a request to access another person’s personal information, please attach either a signed consent form for disclosure for the person(s) involved, OR proof of authority to act on that person’s behalf.
